It is generally up to local communities to decide the procedures for settling legal disputes. There are many ways it can be done, but the ‘adversarial justice system’, where both parties present evidence to a neutral decision maker, is probably the most effective for achieving justice. Although not perfect, the justice system functions well today – it is the laws themselves that are broadly misaligned with the Legal Principle. ‘Obstructing justice’ is included in the Legal Principle’s definition of aggression – but no prescription is offered as to exactly what procedural rights must be adopted to achieve this.
